Another Setback For Gun Grabbing Liberals

FIREARMS INDUSTRY WINS NEW YORK CITY APPEAL . . .


A federal appeals court on Wednesday ordered the dismissal of an eight-year-old lawsuit against firearm manufacturers. The lawsuit, filed in 2000 by then-Mayor Rudy Giuliani, sought to hold manufacturers responsible for the criminal misuse of firearms. "We think Congress clearly intended to protect from vicarious liability members of the firearms industry who engage in the 'lawful design, manufacture, marketing, distribution, importation, or sale' of firearms," Judge Robert J. Miner wrote for the U.S. Court of Appeals. The court held that the Protection of Lawful Commerce in Arms Act, enacted in 2005, is constitutional, and that Brooklyn, N.Y., federal court Judge Jack B. Weinstein misinterpreted the law by not dismissing the case.
