It's ironically fitting that B. Hussein Obama attacks both, the First Amendment and the Second Amendment in the same time:

TALK ABOUT adding insult to injury. The lawyers who successfully challenged the D.C. gun ban are now asking the city's taxpayers to pay their legal fees. The tab: more than $3.5 million.

Under long-established law, plaintiffs lawyers who prevail in certain kinds of civil rights cases are entitled to demand that the loser pay their legal bills. These fee-shifting statutes were enacted in large part to encourage competent lawyers to take on important civil rights cases even though many do not result in money awards. The team of lawyers that took on the District's gun ban sued under such a provision, arguing that prohibiting District residents from possessing handguns in their homes violated the Second Amendment right to keep and bear arms. Having won the landmark case this summer before the Supreme Court, the lawyers are entitled to compensation. What they are not entitled to is the kind of windfall they are seeking.

The lead lawyer in the case, Alan Gura, logged 1,661 hours on the case since taking it on in 2003, according to an Aug. 25 court submission. He has asked the D.C. federal trial judge overseeing the case to pay him $557 per hour; four other lawyers in the case are also seeking that rate. Two other, less experienced lawyers who worked on the case are asking for rates of $494 and $285 an hour, respectively.

Mr. Gura and his colleagues claim the $557 figure is fair because it reflects the going rate for District lawyers who have the same number of years of experience as they do. But this does not take into account the fact that these lawyers are usually with Washington megafirms that have Fortune 500 companies as clients -- and that even these companies get discounts from those astronomical rates.

For Mr. Gura, $557 an hour for 1,661 hours would mean a payday of $925,177. But it doesn't stop there. He argues that because of the "exceptional" nature of the case and the excellent results he secured for his client, he and the others are entitled to double the fees. In Mr. Gura's case, that translates to about $1.85 million -- or roughly $1,100 an hour. Even superstar lawyers in the District do not routinely command such rates.

U.S. District Judge Emmet G. Sullivan should pare back the hourly rate using an index of legal fees calculated by the Justice Department for such cases. At the very least, he should deny the request for double fees. The law requires that Mr. Gura and team receive compensation, but it does not require District residents to foot a bill that would make millionaires of its former adversaries.

Vindication of fundamental civil rights is not an "injury," and asking that the government be held liable for the cost of enforcing our civil rights laws is no "insult" ["Holding Up Taxpayers," editorial, Sept. 6].

Enforcement of our nation's civil rights laws depends on attracting qualified lawyers to fight government agencies with endless resources on behalf of ordinary people who cannot afford legal services.

Awarding successful civil rights lawyers below-market rates for taking such enormous risks would send the bar a terrible message: Ignore injustice, unless you can afford to fight it.

Our requested rates are based on documented market realities, not on the government's wishes about what it would like to pay.

I was shocked at The Post's suggestion that civil rights lawyers are somehow the lesser relations of those who work in "megafirms" serving the Fortune 500. In any event, I and three other members of our team have worked or are still working in those "megafirms."

And if we are such lousy lawyers, how did we manage to beat the city's militia of lawyers, including three of the biggest of the "megafirms" in town?

The Supreme Court also instructs that civil rights victories in exceptional cases entitle the prevailing lawyers to enhanced fees. Our request for fee enhancement is in line with what cases involving abortion, gay rights, police misconduct and other important issues have earned the lawyers who were brave enough to back them. Would The Post feel differently if we had vindicated a right about which it were more enthusiastic, say, freedom of the press?

If the city doesn't want to pay civil rights lawyers' fees, it should obey the Constitution. Freedom isn't free.

What's a community organizer?

Palin Pick Protects Pistol Power, says Gun Law Expert, and Overshadows Obama Oscillation on Second Amendment Issues

“When GOP presidential nominee John McCain last Friday picked Alaska’s sharp shooting Gov. Sarah Palin for his vice-presidential running mate, the selection underscored the significance of Americans’ gun rights in the forthcoming national elections and began to galvanize the Second Amendment movement into support for the McCain candidacy,” right to self-defense advocate John M. Snyder stated here today.

“The McCain-Palin ticket,” Snyder added, “contrasts sharply with gun-grabbing records of Democratic presidential nominee Barack Hussein Obama and vice-presidential nominee Joe Biden.

“McCain signed the congressional amicus brief supporting Dick Heller’s challenge to the District of Columbia handgun ban as a violation of the individual Second Amendment civil right to keep and bear arms. Under Palin’s gubernatorial leadership, Alaska joined a multi-state amicus brief supporting Heller. Both Senators Obama and Biden refused to sign the congressional brief. The Supreme Court agreed with McCain and Palin and threw out the D.C. law in its landmark District of Columbia v. Heller decision on June 26.”

Snyder said, “While McCain notes that, ‘for more than two decades I’ve opposed efforts to ban guns,’ Obama’s been a gun banner from the get go. He has an extensive anti-gun owner public record despite his occasional euphemistic references to the Second Amendment, including the one last week in his nomination acceptance speech. He even had the cynical gall to state he agreed with the Court decision in the Heller case after his campaign had told the Chicago Tribune last November that ‘Obama believes the D.C. handgun law is constitutional.’

“When ABC’s local Washington, D.C. affiliate asked Obama: ‘One other issue that’s of great importance here in the district as well is gun control…but you support the D.C. handgun ban?’ Obama: ‘Right.’ When ABC’s Leon Harris continued with, ‘and you’ve said that it’s constitutional,’ Obama said, ‘right.’”

Snyder recalled also that an Illinois candidate questionnaire revealed Obama supported a general state handgun ban in 1996. He later “flatly denied” the handgun ban statement and blamed it on a state senate campaign staffer for incorrectly filling out the questionnaire. However, the publication Politico located a copy of the filled-out questionnaire. Obama’s own notes in his own handwriting showed that he personally checked answers and corrected them.

“Obama is a shifty character and his election to the highest office in the land would be a tragedy for America’s 80 million law-abiding gun owners and also for the entire country,” noted Snyder. “Some people in political life may try to square the circle, to claim they support both gun rights and Obama, but you can’t have it both ways. You cannot serve both freedom and Obama! You cannot honor both truth and Barack!

“Obama has supported a ban on the sale of all semiautomatic firearms. He and Biden support reinstatement of the Clinton Administration era’s ban on the sale and importation of certain semiautomatic firearms, a ban that was allowed to sunset 10 years after it took effect because of its failure as a crime control measure. Biden voted three years ago against a measure to prohibit harassing third party civil liability actions from being brought or continued against manufacturers, distributors, dealers or importers of firearms or ammunition. By contrast, McCain voted for the measure and it became law, known as the Protection of Lawful Commerce in Arms Act.”

What's Not A Liberal To Hate About Sarah Palin?

Now seriously...you liberals have all the reasons to hate Sarah Palin.
She's not divorced and remmaried tree times; she's a tax cutting, straight talkin', gun tottin', Bambi huntin' good lookin' next-door type of gal. Sarah started her career from absolutely nothing but hard work and determination. As a housewife she didn't asked for the government hand-outs liberals love to push in order to keep their voter base in line. She found enough strength to raise a couple of children and in the same time to become the Governor of the largest US State.


So my liberal friends, rest assured I can understand your disdain for her perfectly. Sarah just isn't a gun hater like Obama and Hillary are. She was never a welfare queen nor accepted food stamps or any other government hand-outs. She never had any friends who are domestic terrorists. Her preacher never said God damn America. Her home in Alaska wasn't partially purchased with money from a convicted felon. Her husband is an Union card carrying member and if you'll ask him when did he started being proud of America he'll probably tell you it was in his childhood and not the day he learned his wife was VP nominee.
Sarah is strong, independent woman and has a great family. She is the American dream come true. And since she represents all that and more, I think it's understandable why you liberals love to hate her.
